Dear Ms. Baker:

Settling this case would require your approval and signature on a Confidential Settlement, Release, and Indemnity Agreement and a Stipulation of Dismissal with Predjudice prepared by Trans Union. Only the Stipulation of Dismissal with Prejudice is filed with the court and if the Judge approves the Stipulation of Dismissal with Prejudice he will sign an Order of Dismissal with Prejudice which would conclude this case.

Trans Union has a standard Confidential Settlement, Release and Indemnity Agreement which contains various provisions including the requirement that the specifics of the settlement not be disclosed, that you do not file complaints with the Federal Trade Commission, Attorney General offices, etc. about this case, that you review your credit file, which would be attached, and verify the accounts accurately appear, that you have had the opportunity to consult with an attorney and have signed that the parties have resolved the controversy between them but does not go into further details. Also, because the Stipulation and Order of Dismissal are with Prejudice, it means that you can not file another lawsuit against Trans Union over the same issues which in this case would be the investigation of your file where Trans Union requested your social security number and you didn't send it in. You do not waive any future rights to sue Trans Union if for example an error appears on a future credit report.  It would only apply to this case.

As you know, when Trans Union received your dispute another "possible" file came up. Trans Union has standard procedures in place when "possible" files come up when a consumer credit file is accessed. These procedures are time tested as the best and safest way to get to the bottom of any possible confusion between files, to determine who a "possible" file belongs to, and/or to prevent any consumer or fraud perpetrator from obtaining a credit file on someone else other than him/herself.  This is why your social security number was requested.

We are still waiting on a response from Professional Recovery.  I will forward your updated credit file to you as soon as I receive it.

Please let me know as soon as possible whether you would like to settle this matter.  If you settle, you would not have to answer the discovery that I sent you. It would also relieve me from filing additional motions with the Court.  As soon as you tell me you are willing to settle, I will notify Trans Union and have them write you a check for $250.  As soon as I receive back the signed settlement papers, I will forward the check to you.
