RE:
Christine Baker v. Trans Union, LLC, Case No. 801 2001 CV 1751 UN; In the
Justice Court of Mohave County, Kingman, AZ.
Dear Ms. Stamps:
Thanks for your prompt reply.
1) I am still waiting for the
credit report you mentioned. Did the fax get lost?
2) Also, apparently
you missed my statement on page 8 of my letter dated January 16, 2002:
"I will increase my claim to $10,000 as the small claims limit no longer
applies." It was also clearly referenced on page 1.
So, I won't be
accepting your offer to settle for no PIN, an incomplete Trans Union credit
report and reimbursement of my $50 legal + filing fees.
Remember that
phone conversation we had on October 17, 2001, specifically my explanation of my
damages?
3) Regarding your statements about Fair, Isaac, I am contacting
them for clarification.
4) You wrote in your faxed letter dated 1/23/01
that just last week your internal investigation of the TU refusal to investigate
my disputes was completed. It took 3 months, but you didn't inform me of the
results of your investigation.
What happened? WHY did TU refuse to
investigate my disputes?
5) Regarding your refusal to provide me with my
user changeable PIN, I'm wondering what ** I ** should do when THIS happens to
me:
"I just found out that they have applied for 2 credit cards via the
internet. They have my birtdate, SS#, address and even my mother's maiden name.
I have added a fraud alert, but with this much info, do I need to take more
drastic measures. I'm a little panicked on what they can access, how they got
it, and what can I really do."
a) What do you recommend we should do?
b) What exactly does TU do after notification of fraud?
c) How
will it impact on my ability to get NEW credit offers?
d) A PIN would
PREVENT these problems. Are you accepting responsibility for all damages
resulting from your refusal to offer user changeable PINs to every person you
maintain a file on?
6) I was just looking at one of my old TU reports,
and I'm having trouble finding my accounts or any logic with their order. Well,
disorder. Could you please sort the accounts on my credit report alphabetically?
7) I'm looking at a Trans Union credit report obtained from
worthknowing.com. It lists a credit inquiry by "CONSUMERINFO." I am aware that
you stated in your last letter that Trans Union has NO other information about
inquiries. But, I just want to double check.
Are you absolutely SURE
that you don't have any data related to that inquiry that would tell Fair,
Isaac's credit scoring software whether to count it as a "score lowering
inquiry" or not?
8) How does Trans Union handle requests for deletion of
unauthorized inquiries?
9) Where can I e-mail and fax disputes?
10) If those disputes are not resolved to my satisfaction, who would I
contact PRIOR to filing a law suit?
11) What's the proper authorization
so I can have someone else monitor, dispute and discuss my report with TU while
I'm camping?
I very much appreciate your answers via fax to (deleted.)
Also, there is no need to add my current PO Box to my credit report as this is a
temporary address.
Sincerely,
Christine Baker
